These Terms and Conditions (“Terms”) govern the supply of services by Sydney Street Projects (“SSP”, “we”, “our”, “us”) to any person or entity (“you”, “the client”). By requesting a quote, accepting a quote, signing a job sheet, or otherwise instructing SSP to perform work, you agree to be bound by these Terms.
Scope: These Terms apply to all services provided by SSP including site audits, pre‑quote inspections, junk removal, property clean‑ups, corrective‑action work, before/after reporting, and any related consultancy, training or merchandise sales where applicable.
Priority: Where a written contract between the parties exists, that contract prevails to the extent of any inconsistency. These Terms otherwise form the entire agreement between the parties.
2.1 Quotes and Estimates.
All quotes are valid for the period stated on the quote. If no period is stated, quotes expire 14 days from issue.
Quotes are based on information available at the time and are estimates unless expressly stated as fixed.
2.2 Acceptance.
A contract is formed when you accept a written quote, sign a job sheet, or otherwise provide written or electronic acceptance. Verbal acceptance may be confirmed in writing by SSP.
2.3 Site Inspections.
If SSP attends a site to provide a quote and identifies significant safety or access issues, we will notify you and may revise the quote or decline to proceed until issues are resolved.
A. Pricing: All prices are stated in Australian dollars and exclude GST unless otherwise indicated.
B. GST: Where applicable, GST will be added to invoices at the statutory rate.
C. Payment Terms: Standard payment terms are 28 days from the date of invoice. 7 days is the preferred payment period and may be requested on quotes; earlier payment terms may attract a discount where offered. For work performed for government or other public sector clients, SSP will comply with the payment terms required by that client’s procurement rules.
D. Late Payment: Overdue amounts may incur interest at a rate of 8% per annum above the Reserve Bank cash rate, calculated daily, plus any reasonable debt recovery costs.
E. Deposits: SSP may require a deposit or progress payments for certain jobs; these will be specified in the quote.
A. Client Cancellations: If you cancel a job after acceptance, you may be liable for reasonable costs incurred up to the time of cancellation, including travel, labour and materials.
B. Variations: Any variation to the scope of work must be agreed in writing. Additional work will be charged at the agreed rate or, if not agreed, at SSP’s prevailing rates.
C. Refunds: Refunds, if any, will be handled in accordance with the Australian Consumer Law and these Terms.
A. Site Access: You must provide safe and reasonable access to the site, disclose known hazards, and obtain any necessary permissions or permits.
B. Safety Priority — Safety Is SSP’s Priority: SSP reserves the right to suspend or refuse work where conditions are unsafe. If work is suspended for safety reasons, additional costs arising from delay or remediation may apply.
C. Incident Reporting: When performing work on a client site, SSP will use the client’s incident reporting systems where available. For other sites, SSP will follow its own incident reporting procedures and will notify the client promptly of any incidents.
D. Client Responsibilities: You must secure pets, children and personal property, and advise SSP of any special site requirements or insurance conditions prior to work commencing.
A. Operational Use: SSP may take photos or videos for site audits, pre‑quote assessments, corrective‑action documentation, and before/after reports. These materials are used for operational, quoting and record‑keeping purposes.
B. Client Reports: Any audit or report prepared by SSP is based on conditions observed at the time and is not a formal engineering, structural or compliance certification unless expressly agreed in writing.
C. Marketing Use: SSP will not use photos or videos for marketing, social media or public display without your explicit permission.
D. Ownership: SSP retains ownership of operational records, photos and reports created by SSP unless otherwise agreed. Where clients request originals or copies, SSP will provide them on request subject to reasonable administrative charges.
E. Licence to Use: Where SSP publishes client‑approved images or case studies, SSP will obtain written permission and will credit the client as agreed.
A. Subcontracting: SSP may engage subcontractors or suppliers to perform parts of the work. SSP remains responsible for the subcontracted work to the extent required by law.
B. Personnel and Trainees: SSP may use trainees or supervised personnel as part of its community and training programs. SSP will supervise trainees and maintain appropriate insurance and supervision standards. Clients will be notified if trainees will be present on site where required.
A. Service Warranties: SSP will perform services with reasonable care and skill. Any specific workmanship warranties will be set out in the quote or job documentation.
B. Consumer Guarantees: Nothing in these Terms excludes or limits your rights under the Australian Consumer Law (ACL). To the extent permitted by law, SSP’s liability for breach of non‑excludable guarantees is limited to, at SSP’s option, re‑supply of the services or payment of the cost of re‑supply.
C. Limitation of Liability: Except for liability that cannot be excluded by law, SSP’s liability for any claim arising out of or in connection with these Terms is limited to the total fees paid by you for the relevant job. SSP is not liable for indirect, special or consequential loss.
D. Indemnity: You indemnify SSP against any loss, damage or liability arising from your breach of these Terms, your negligence, or your failure to disclose site hazards.
A. Insurance: SSP maintains public liability and workers’ compensation insurance appropriate to its operations. Evidence of insurance can be provided on request.
B. Risk: Risk in goods supplied (if any) passes to you on delivery or collection. For services, risk remains with SSP until completion, except where otherwise agreed.
C. Title: Title to any goods supplied remains with SSP until full payment is received.
A. Privacy: SSP handles personal information in accordance with its Privacy Policy, available on the website. That policy explains how we collect, use, store and disclose personal information.
B. Operational Records: Client information, photos and reports are stored securely on the SSP office computer and authorised systems. Crew members working on a job will have access to job addresses and relevant details only.
C. Data Breach: SSP has procedures to respond to data breaches and will notify affected individuals and the OAIC where required by law.
D. Retention: Records are retained in accordance with legal and insurance requirements; typical retention periods are set out in the Privacy Policy.
A. Current Position: SSP does not currently sell merchandise or participate in affiliate programs. If SSP begins selling products or participating in affiliate programs, a dedicated Products page will be published and all relevant disclosures (including returns, shipping, GST, affiliate commissions and consumer guarantees) will be provided.
B. Future Sales: When merchandise or affiliate links are active, SSP will comply with applicable consumer protection and advertising laws.
A. Dispute Resolution: In the event of a dispute, the parties will first attempt to resolve the matter by good faith negotiation. If unresolved, the parties agree to attempt mediation before commencing court proceedings.
B. Force Majeure: SSP is not liable for delay or failure to perform caused by events beyond its reasonable control (including extreme weather, industrial action, government restrictions, or supply chain disruption). SSP will notify you and take reasonable steps to mitigate delay.
C. Governing Law: These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non‑exclusive jurisdiction of the courts of NSW.
Changes: SSP may update these Terms from time to time. The latest version will be published on the website. Continued instruction or acceptance of quotes after a change constitutes acceptance of the updated Terms.
Notices: Notices must be in writing and sent to the contact details below. Electronic communications (email) are effective when sent.

Severability — If any provision of these Terms is invalid or unenforceable, it will be severed and the remaining provisions will continue in force.
No Waiver — A failure or delay by SSP to exercise a right does not operate as a waiver of that right.
